Jack in the Box and FTX have reached a non-disclosure agreement over a copyright lawsuit involving the mascot, suggesting that the days of the Moon Man in its current form may be over.
Jack in the Box’s lawsuit against FTX US for alleged copyright and trademark infringement related to the mascot ended after the parties reached an agreement.
The duo are aware of the District Court for the Southern District of California that they settled the dispute through a motion of dismissal on January 20, however the specifics of the settlement have yet to be released. .
The popular fast-food chain originally filed a lawsuit in early November, alleging that the appearance and behavior of FTX US’s “Moon Man” mascot was a rip-off of the mascot. Jack” by Jack in the Box has trademark rights since 1995.
Jack in the Box was initially seeking unspecified damages for allegations related to copyright infringement, trademark dilution, trademark infringement, misassignment of origin, and unfair competition.
“Instead of spending huge financial resources to develop its own intellectual property, FTX blatantly and illegally copied or derived the ‘Moon Man’ mascot from JITB’s Jack. ,” the company alleges in court documents from November.
